Purpletree License Terms

This License is entered by PurpleTree Software LLP (aka Purpletree, Purpletree Software, Company) to govern the usage or redistribution of source code owned by PurpleTree Software LLP. This is a legal agreement between you (either an individual or a single entity) and "PurpleTree Software LLP" for PurpleTree Software LLP product(s) which may include extensions, templates, and other products or services.

By purchasing, installing, or otherwise using company products, you acknowledge that you have read this License and agree to be bound by the terms of this agreement. If you do not agree to the terms of this license, do not install or use the company products.

The agreement becomes effective at the moment when you acquire software from our site or receive it through email or on a data medium or by any other means. The company reserves the right to make reasonable changes to the terms of this license agreement and impose its clauses at any given time.

 

1. Grant of license

 

By purchasing a product of PurpleTree, the customers will receive source code developed by the company. The customer will obtain a License which will remain valid until the customer stops using the product or until the company terminates this license because of the customer's failure to comply with any of its Terms and Conditions. Each license certificate includes a license serial which is valid for one live installation only and two test installations only.

 

2. Description of other rights and limitations

 

Installation and Use:

For each new software installation, you are obliged to purchase a separate license. You are not permitted to use any part of the code in whole or part in any other software or product or website.

Distribution:

You are not allowed to distribute PurpleTree Software LLP's developed source code, in part or full, to third parties. Any distribution without our permission, including non-commercial distribution, is considered a violation of this agreement and entails liability, according to the current law. You may not place company's software, or any software that uses company's source code, or depends on it, onto a server that allows access to the software via a public network or the Internet for distribution purposes. Our software may remove or disable any third party scripts, found in violation of this policy.

Rental:

You may not give, sell, sub-license, rent, lease or lend any portion of the company's developed software to anyone.

Compliance with Applicable Laws:

You must comply with all applicable national and international laws regarding the use of company's software products. Company's software or any portion of it are protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. Accordingly, the customer is required to treat the software like any other copyrighted material. Any activity violating copyright law will be prosecuted according to the current law. We retain the right to revoke the license of any user holding an invalid license, and/or use digital copyright laws to prohibit illegal or unauthorised use of compay's software.

3. Termination

 

Without prejudice to any other rights, PurpleTree may terminate this License at any time if you fail to comply with the terms and conditions of this License. In such event, it constitutes a breach of the agreement, and your license to use the program is revoked and you must destroy all copies of PurpleTree products in your possession. After being notified of the termination of your license, if you continue to use PurpleTree software, you hereby agree to accept an injunction to prevent you from its further use and to pay all costs (including but not limited to reasonable attorney fees) to enforce our revocation of your license and any damages suffered by us because of your misuse of the Software. We are not bound to return you the amount spent on the purchase of the Software for the termination of this License.

This website contains material that is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance, graphics, and the software/items we sell. Reproduction of any material, in full or in part, is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions. Any misuse of such material may invite strict actions, including blacklisting of the user without obligations and/or appropriate legal action.

 

4. Limitation of Liability

 

In no event shall PurpleTree be liable for any damages (including, without limitation, lost profits, business interruption, or lost information) rising out of Authorized Users' use of or inability to use the PurpleTree products, even if PurpleTree has been advised of the possibility of such damages. In no event will PurpleTree be liable for prosecution arising from the use of the Software against law or for any illegal use.

 

5. License Usage Terms

 

Our products require a license to work.

One license is valid for only one production website/domain/subdomain.

One license is provided on the purchase of one quantity of the extensin/theme.

In addition, you can also use the same license on maximum of two test websites/domains/subdomains.

License usage for Development or Test purpose

We allow using a valid license on maximum of two development/test Instances.

A domain or subdomain is considered a development/test instance if it contains any of the strings "test" or "demo" or "localhost" or no alphabets (all numbers, i.e. an IP address) in the domain/subdomain name. It is also considered a development/test instance if it starts with "beta." or starts with "staging." or starts with "dev.", or ends with ".local".

Examples: mytest.abc.com or demo2.xyz.com or mydemo.com or http://localhost/mywebsite or http://127.0.0.1/mywebsite or http://11.22.33.44/abc

You can use your license on maximum 2 development/test domains/subdomains.

Multi-Store setup

This section does not cover the case when there are multiple installations. This case only explains the case where only one installation is available.

In the case of a Multi-store-based setup (multiple online stores being served by a single installation), if you want to use the same license on multiple websites/domains/subdomains, all the websites/domains/subdomains must be owned by the same person/company. This requires a written undertaking from the customer's side, in a prescribed format.

One license covers a maximum of 05 websites/domains/subdomains available in the same installation. For more websites/domains/subdomains, more licenses would be required in the same proportion.

If any of the website/domain/subdomain belongs to a different business, you would need a separate license for every such website/domain/subdomain.

In case an extension explicitly allows multiple websites/domains/subdomains belonging to multiple sellers (called multi-seller-domain extension, like Opencart Multi Vendor extension), they must be served from the same installation (manual verification is required) and a maximum of 05 websites/domains/subdomains are allowed for one license. For more websites/domains/subdomains, more licenses would be required in the same proportion.

If a website has a multi-vendor feature available, and the vendor stores are not configured to use separate websites/domains/subdomains then there is no limitation on the number of seller stores/pages allowed, as they all use only one website/domain/subdomain.

Examples

- Having 04 websites/domains/subdomains belonging to the same business being served from the same installation: 01 license is required.

- Having 06 websites/domains/subdomains belonging to the same business being served from the same installation: 02 licenses are required.

- Having 03 websites/domains/subdomains, not belonging to the same business, being served from the same installation: 03 licenses are required.

- For multi-seller-domain extension - 05 sellers are assigned one websites/domains/subdomains each, being served from the same installation: 01 license is required.

- For multi-seller-domain extension - 07 sellers are assigned one websites/domains/subdomains each, being served from the same installation: 02 licenses are required.

Changing domain in the license

One license usually allows operation on one production (non-test and non-development) website/domain/subdomain, unless you buy multiple licenses.

If you have purchased more than 01 quantity of license, you can use the extension on multiple websites/domains/subdomains, according to license quantity.

If you want to change the domain/subdomain in your license, it is allowed one time within 6 months of the purchase. Change of license is a manual process and a ticket should be raised in our helpdesk for the same. The domain/subdomain can be changed for the license only once.
